INTEGRATION OF INTERNATIONAL MARITIME LAW AND CUSTOMS LAW:
CHALLENGES AND PERSPECTIVES FOR SUSTAINABILITY AND EFFICIENCY IN MARITIME TRANSPORT OPERATIONS AND FOREIGN TRADE

Maritime transport and international trade are fundamental to the global economy but face significant challenges due to the complex network of regulations involving International Maritime Law and Customs Law. The proposed research problem is: "What are the legal and regulatory challenges in integrating the systems of International Maritime Law and Customs Law to promote sustainability and efficiency in maritime transport and international trade operations?" The effective integration of these systems is essential for ensuring safe, environmentally responsible, and efficient operations, protecting both workers' rights and national sovereignty. Aspects such as the harmonization of international conventions, including UNCLOS, MARPOL, and the Hague-Visby Rules, with customs regulations, and the application of national legislation such as Law No. 9,537/97 (the Maritime Traffic Safety Law) are crucial for compliance and efficiency. Additionally, the responsibility of the carrier, environmental protection, waste management, and maritime safety issues are highlighted, as well as the application of the MLC 2006 Convention for seafarers' rights and the role of technology in improving compliance and customs management. This study aims to explore the legal and practical implications of this integration, considering the challenges of coordinating regulations and processes to promote sustainability, protect the environment, and enhance the efficiency of international trade and maritime transport processes.
