Efeitos econômicos das regulamentações ambientais internacionais no transporte comercial marítimo

Abstract

This article aims at studying the economic effects arising from international environmental commitments for the regulation of the maritime transport sector. The reason for this is that this modal is the most used worldwide, corresponding to 90% of the freight transport, as well as being the least polluting one. Despite that, it quantitatively contributes to environmental pollution. Thus, following the Sustainable Development Goals of the UN Agenda 2030, we seek to study how environmental regulatory control affects the economy of this sector. The Law and Economics School is mentioned as a theoretical framework to support the relationship between Environmental Regulatory Law and international economic praxis related to commercial maritime transport, as well as the Principle of Economic-Social Efficiency, joining the analysis of conventions and the IMO 2020 Initiative, to indicate possible economic effects when making decisions. The methodology includes the legal analysis of international normative texts, qualitative and quantitative analysis on economic data shown in graphs, as well as deductive method, in order to conclude, based on what is studied, how Law affects the Economy within the scope of the regulation of international commercial maritime transport, helping agents from this sector in the decision-making process.
