Abstract

The scope of this work is to analyze what would be the legal criteria for granting of provisional decision for the release of merchandise from abroad. First, it will examine whether or not there is a legal prohibition in abstract for granting provisional decision in this matter; then, the requirements of the fumus boni juris, the periculum in mora and the irreversibility of the measure, applied specifically in customs matters will be discussed; finally, the need, or not, of a guarantee in case of granting provisional decision will be analyzed.

Doutorando em Ciências Jurídico-Processuais pela Universidade de Coimbra (Portugal). Mestre em Direito Processual pela Universidade Federal do Espírito Santo (UFES). Professor de Pós-Graduação da ESMAGES, FUCAPE e IBET. Juiz Federal Substituto lotado na 2ª Vara Federal Cível de Vitória (ES) - TRF 2. Ex-Procurador do Estado do Espírito Santo. Tem experiência na área de Direito, com ênfase em Direito Processual Civil e Direito Processual Tributário.
