DIREITO DE LOCOMOÇÃO DOS POVOS RIBEIRINHOS E A EFETIVIDADE DOS DIREITOS FUNDAMENTAIS

Abstract

This paper aims to establish the negative relationship caused by the incipient positive rendering of the right of locomotion in the other fundamental rights. It works in what way the lack of application of the principle of isonomy in the right to come and go implies in the life of riverside peoples. It is a regionalized approach on specific situations of the Amazon, Amapá, Macapá, District of Bailique in terms of the existential minimum, diagnosing the social impacts that the State’s failure to do causes in the lives of people who live on the banks of rivers in part of the northern region of Brazil. It also points to the need to apply inequality in the law to address the social disparities experienced by riverside dwellers compared to other locations that have land access. Methodologically, the work presents bibliographical research, empirical knowledge, a case study and is strategically divided in order to understand meanings about fundamental rights, the role of the state as a guarantor of rights, state negligence in the provision of assistance and final considerations, which refer to the analysis of the facts discussed throughout the article. It is a structured work with the purpose of understanding the extremities experienced in the locomotion of those who have a road to come and go and those who need the river.
